SALETECH PTY LTD, T/AS STEP AHEAD PAEDIATRICS
1. Definitions
1.1 “Supplier” refers to Saletech Pty Ltd, t/as Step Ahead Paediatrics.
1.2 “Client” means the person/s buying the Goods as specified in any invoice or document, and if there is more than one Client it is a reference to each client jointly and severally.
1.3 “Goods” refers to all Goods and Services being supplied by the Supplier to the Client
1.4 “Price” means the Price payable for the Goods agreed between the supplier and the Client in accordance with the Terms of Sale
2. Acceptance
2.1 The Client is taken to have accepted and is immediately bound by these Terms of Sale, when purchasing or hiring any Goods from the Supplier.
2.2 These Terms of Sale may only be amended by the Supplier, or persons acting on behalf of the Supplier.
3. Pricing
3.1 The Supplier reserves the right to increase prices without notice.
3.2 The Price charged to the Client shall be either:
(a) The Price indicated on the most recent invoice provided by the Supplier; or
(b) the Price according to the Quote (Project) which shall be valid for thirty days (30) or the period stated on the document.
4. Payment
4.1 Payment for Goods provided by the Supplier, shall be payable before delivery of the Goods.
4.2 Payment shall be remitted by Electronic Funds Transfer, credit card, or bank cheque.
4.3 GST, and other applicable taxes, must be included in payment for the Goods.
5. Delivery
5.1 Delivery occurs on the date when Goods have been received at the nominated delivery address, either by courier, mail or in-person delivery.
5.2 Regardless of the timeliness of delivery, the Client must accept delivery of the Goods.
5.3 The Supplier does not accept liability for loss or damaged experienced by the Client as a result of late delivery.
6. Use of all Goods Purchased, Hired or Trialled from the Supplier
6.1 All Goods sold by the Supplier, hired, or trialled from the Supplier, are supplied only for the purposes of mobility, or for medical or postural support.
6.2 The Goods are not to be used as a restrictive practice in relation to any person with a disability, other than where the use is in an accordance with an authorization (however described) of a State or Territory in relation to the person or a behaviour support plan for the person.
6.3 All goods sold by the Supplier are sold based on the conditions described in clauses 6.1 and 6.2
above.
6.4 All goods hired or trialled must be returned to the Supplier in original condition. The Supplier reserves the right to invoice the Client for any missing or damaged parts of the Goods, or any additional cleaning, repair, or replacement costs.
6.5 The Client shall not alter or modify or attempt to alter or modify any part of the Goods provided for Purchase, Hire or Trial.
7. Risk
7.1 Where the Client has requested Goods to be left unattended, the Goods will be left at the Client’s own risk.
9. Title
9.1 Ownership of the Goods is only transferred to the Client once the Supplier has received payment for the Goods in Full.
10. Defects
10.1 Any defects or missing items must be reported to the company within a reasonable timeframe.
11. Returns
11.1 Returns are only accepted by prior agreement with the Company, and in accordance with Australian Consumer Law
12. Disclaimer
12.1 In agreeing with these Terms of Sale, the Client is regraded to have disclaimed any right to rescind or cancel and order, or sue for damages due to any inadvertent misrepresentation made by the Supplier regarding the Goods supplied.
12.2 These Terms of Sale shall be governed by the laws of Australia and are subject to the jurisdiction of the state of Victoria.
12.3 In the event of an act of God, interruption due to war, terrorist activity, strikes or natural disasters, neither party shall be held liable.
